How Montero's Law Has Benefited a Man Who Abused His Seven-Year-Old Sister

According to Okdiario, this time it is about a sentence reduction that supposedly occurred on January 30, carried out by the Supreme Court. Allegedly, it involves a man who, according to the newspaper, sexually abused his younger sister for a decade. Allegedly, it began when the victim was only seven years old and continued until she was 17.

The events in question refer to an incident that occurred in Almería starting in 1999. Allegedly, the convicted was eight years older than the victim, taking advantage of the minor's vulnerability due to being much younger than him.

According to the media, the incidents began with touching and escalated to "continuous rapes" when the victim turned 12, which allegedly took place in various locations. From the family home to the locker rooms of a sports center.

Allegedly, the aggressor was threatening his sister, warning her that their family would blame her if they found out. The situation escalated to the point of threatening to kill the victim.

Through WhatsApp, he sent messages that led the victim to report in 2018. "I'm going to cut your throat" and "I'm capable of slashing you," the messages allegedly read.

The continuous abuse has left deep psychological scars on the victim, who faces depression, anxiety, and chronic post-traumatic stress disorder, making permanent therapeutic treatment necessary. This is what the newspaper claims.

Initially, the Provincial Court of Almería imposed a sentence of 14 years, 3 months, and 1 day in prison on the aggressor. However, with the entry into force of the Montero Law, the convicted requested a review of his sentence, arguing that the new regulation was more favorable to him. Following the doctrine established in June 2023, the Supreme Court has decided to reduce the sentence to 13 years, 9 months, and 1 day.
