Justice Dismisses Another Complaint Against Ayuso Over Covid Management

The Judge highlights that the protocols established during the pandemic were followed by the center

The Investigative Court Number 4 of Madrid has issued a dismissal order in the case of the six residents who died due to COVID-19 at the Adolfo Suárez Nursing Home, following a complaint by Marea de Residencias. This order supports the management of the nursing home and concludes that no negligence occurred.

The Judge Highlights That the Protocols Established During the Pandemic Were Followed by the Center. In the forensic doctor's report, it is clarified that the deaths were not the result of negligence. The situation experienced during the first wave of the pandemic was exceptionally difficult, and the available decisions were made under extreme circumstances.

The order also reviews the challenging moments faced by hospitals and health centers. At the beginning of the pandemic, healthcare facilities were overwhelmed. There was no clear understanding of how to treat COVID-19, and medical equipment was insufficient.

In that context, nursing homes like Adolfo Suárez faced great difficulties.

One of the main problems highlighted was the lack of basic protective equipment, such as masks, and the shortage of devices like high-flow oxygen. Additionally, the high rate of infections among healthcare and support staff further aggravated the situation. In this context, the incidence of the virus was much higher among the most vulnerable people, such as the elderly with pre-existing conditions.

According to the forensic report, the efforts to care for the residents were the best possible given the circumstances. This Adds to the Reiteration That There Was No Negligence in the Care of the Residents. This conclusion, according to the order, underscores the great complexity of the circumstances faced by those who worked in the healthcare and support sector during the first months of the pandemic.

The judicial resolution adds to 23 other court decisions that support the management of the Community of Madrid during the health crisis. These decisions reinforce the position of President Isabel Díaz Ayuso, who has publicly defended the work done by nursing home professionals.

The political situation surrounding the management of the pandemic has remained controversial. Recently, Miguel Ángel Rodríguez, Chief of Staff of President Ayuso, publicly apologized for questioning on social media the authenticity of the testimonies of the relatives of the deceased.
