The 'Lost' Evidence Against Bolaños's Senior Official Has Already Been Delivered Again

The judge issued an order on January 28 requesting the recording, and the Civil Guard has provided it again.

One of Bolaños's high-ranking officials is at the center of controversy. The judicial process against Aitor Cubo, Director General of Digital Transformation of the Administration of Justice, continues its course.

According to El Independiente, the Civil Guard has once again presented the key evidence that had previously been "lost." It had been misplaced in a court in Madrid.

Additionally, the investigating magistrate has set a new date for Cubo to appear as a suspect. All in relation to the alleged manipulation of an audio of a minor in a parental custody case.

Initially, it was expected that Aitor Cubo would testify last October, but the appearance was suspended. This happened after his defense, represented by the State Attorney's Office, claimed not to have had access to the main evidence. This evidence consists of a recording of a 12-year-old boy that, according to the investigation, had been intentionally altered.

The judge requested the dean's office in Madrid to provide the file, but it replied that the material had been "misplaced." Faced with this situation, the Prosecutor's Office asked the accusation, led by the boy's father, to deliver the recording.

However, the complainant's lawyer opposed this, arguing that it could compromise the chain of custody. The magistrate supported this stance, dismissed the prosecutor's request, and ordered the Civil Guard to present the evidence.

On January 28, the judge issued an order demanding the recording again, and the Civil Guard has delivered it once more, this time in CD format. Subsequently, on February 17, the magistrate set the date for Aitor Cubo's testimony, which will finally take place on May 27 at 11:00 a.m.

Before him, the boy's father will testify, and after the intervention of the high-ranking official from the Ministry of Justice, two experts will appear. These specialists play a key role in the case, as they were the ones who certified that the recording was altered. They pointed out that the "pink noise" technique was used.

What Happened in the Case Involving Bolaños's High-Ranking Official

The high-ranking official, under the direction of Minister Félix Bolaños, is being investigated for alleged manipulation in a minor's statement. Magistrate Susana Trujillano has summoned him again for May 27. This after the first appearance, scheduled for October 2, was postponed.

At that time, the State Attorney's Office argued that Cubo had not had access to the audio file, which inexplicably went missing from the Investigative Court number 7 in Madrid.

This is confirmed by The Objective. The restricted access to a key recording prevented Cubo from defending himself with guarantees in his judicial statement, according to the high-ranking official's defense.

The State Attorney's Office, which is defending him, denounced the situation. This led to the suspension of the appearance after a tense 20-minute exchange between the prosecutor, the accusation, and the State Attorney about the legitimacy of his representation.

The partial disappearance of a judicial recording has triggered an investigation for alleged forgery of public documents. The file corresponds to the statement of a 12-year-old boy in March 2022. In the context of a custody process held in the Court of Violence against Women number 1 in Valladolid.

Although the recording is almost entirely preserved, the part corresponding to the boy's testimony shows alterations. This anomaly has put Aitor Cubo, Director General of Digital Transformation of the Ministry of Justice, under suspicion, summoned as a suspect last April.
