The magistrate asked him to justify his legitimate interest in the investigation and requested a bond of 10,000 euros, the same amount required of the other popular prosecutions.

In his brief, the former judge, who currently presents himself as a lawyer, argued that his motivation was to contribute to the fight against corruption. He asserted that as a citizen, he has the right to ensure the protection of public funds. Additionally, he highlighted his history of denouncing corruption since 2013 and his creation of an association to combat it.

However, the judge recalled that Sáenz de Tejada had been expelled from the judiciary. This occurred after he was sentenced in 2017 to a prison term for intentional crimes, which was reflected in the BOE.

She also noted that, in his "fight" against corruption, the former judge has filed legal actions not only against the professionals involved. But also against the members of the CGPJ who decided his removal as a magistrate.
