The new twist in Sánchez's brother's case that puts him against the ropes

The decision dismisses the appeal filed by the Prosecutor's Office, which sought to halt the investigation into alleged irregularities in his hiring at the Diputación de Badajoz.

The Provincial Court of Badajoz has confirmed the summons as an investigated party of David Sánchez, brother of the Prime Minister, Pedro Sánchez.

The decision dismisses the appeal filed by the Prosecutor's Office, which sought to halt the investigation for alleged irregularities in his hiring at the Badajoz Provincial Council.

The investigation, led by Judge Beatriz Biedma, has caused considerable public interest by pointing to possible crimes of influence peddling, prevarication, and embezzlement of public funds in the Badajoz Provincial Council.

The central figure of the case is David Sánchez, hired under circumstances that, according to the accusation, may have involved undue favoritism.

The Prosecutor's Office had argued that the initial order didn't sufficiently delineate the imputed facts. This, in their opinion, compromised the right of defense of those involved.

However, the Court has rejected this stance, stating that the order has sufficient motivation to continue with the process. "The investigated parties have their procedural rights guaranteed and will be able to clarify their position during the proceedings," the court noted in its resolution.

One of the key elements of the investigation has been the intervention of corporate emails. A measure that has sparked debates about privacy and the balance between the search for evidence and respect for individual rights.

For the judges, this intervention has been crucial to justify the summons of Sánchez and the president of the Badajoz Provincial Council, Miguel Ángel Gallardo.

This case puts the spotlight on the relationship between politics and public administration. Although those close to Pedro Sánchez have insisted on dissociating the president from the matter, the opposition hasn't hesitated to use the case to launch criticisms.

At the judicial level, the Court's ruling sets a precedent by emphasizing that the lack of detail in an order doesn't necessarily entail defenselessness, as long as the affected parties have the opportunity to prepare their arguments. The investigated parties will be able to request an extension to prepare their defense, a right guaranteed by the current legal framework.

The progress of this investigation reinforces the importance of ensuring transparency in public management and equality before the law. Although the case is still in a preliminary phase, its impact is already being felt in political and social spheres.

Everything seems to indicate that 2025 will start with a loaded judicial agenda. This will bring even greater scrutiny on those who hold positions of power in Spain.
