However, with the new regulation, each municipality must establish a specific fee that reflects the actual cost of the service. Citizens must be informed about this new obligation and collaborate in waste reduction and recycling to contribute to environmental care.

Mandatory to Apply Starting April 10

From April 10, 2025, all municipalities with more than 5,000 inhabitants are required to apply this fee. Law 7/2022, of April 8, establishes that the fee must be specific, differentiated, and non-deficit, meaning it must cover 100% of the service cost.

This measure is based on the principle of "the polluter pays". It is executed by encouraging citizens to reduce waste generation and promote recycling.

What Happens If Municipalities Don't Apply the Fee?

If a municipality doesn't apply the waste management fee, it faces sanctions from Hacienda. The Tax Agency has the authority to impose fines on municipalities that do not comply with this obligation.

Additionally, citizens could be affected by the lack of resources for proper waste management. This could impact the quality of the service and the environment.

Hacienda has already made it clear to municipalities that the application of the waste management fee is mandatory and must be complied with within the established timeframe. The Tax Agency has indicated that municipalities that do not implement the fee risk economic sanctions. Furthermore, it has emphasized the importance of municipalities adequately informing citizens about the new fee and its application.
